EMROSE ("we", "us", "our store") recognises the importance of protecting personal information. We comply with Japan's Act on the Protection of Personal Information (the "Personal Information Protection Act") and have established the following Privacy Policy (this "Policy").
1. Definition of personal information
In this Policy, "personal information" means information about a living individual as defined in Article 2, Paragraph 1 of the Personal Information Protection Act, which can identify a specific individual by name, date of birth, address, telephone number, or other description contained in that information (including information that can easily be cross-referenced with other information and thereby identify a specific individual), or information containing an individual identification code.
2. How we collect personal information
1. When you register to use our services, we may ask for personal information such as your name, date of birth, address, telephone number, email address, bank account number, credit card number, or driver's licence number. We may also obtain transaction records containing your personal information, and payment-related information, from our partners (including information providers, advertisers, and advertising distributors).
2. We collect history and attribute information when you use our services or those of our partners, or view our pages. This includes the services and software you have used, the products you have purchased, your history of viewed pages and advertisements, search keywords, dates and times of use, how you used the service, your usage environment (including the communication status of your mobile device and its various settings), your IP address, cookie information, location information, and device identifiers.

- Providers of the platform behind our website and services (such as Shopify)
- Payment processors (bank account details, credit or debit card information, and billing address, to the extent required for payment)

We collect and use your personal information for the following purposes.
1. To display your registered information — such as your name, address, contact details, and payment method — together with the services you have used, the products you have purchased, and the amounts charged, so that you can view and amend them.
2. To use contact details such as your name, address, and email address in order to send you notices and products, and to contact you where necessary.
3. To verify your identity, using information such as your name, date of birth, address, telephone number, bank account number, credit card number, driver's licence number, and the results of delivery-certified mail.
4. To bill you for products, using information such as the names and quantities of the products purchased, the type, period, and number of services used, the amount charged, your name, address, and payment information such as bank account or credit card numbers.
5. To make data entry easier, by displaying registered information in input forms or, at your instruction, transferring it to other services (including those provided by our partners).
6. To decline service to customers who have breached our terms of service — for example by delaying payment or causing loss to a third party — or who attempt to use the service for improper purposes, using information such as usage patterns, name, and address that identifies an individual.
7. To respond to your enquiries, using the content of your enquiry, billing information, your usage of the service, your contact details, and other information necessary to provide the service to you.
8. To send you news, advertising, and campaign information about our products and services by email, social media, or other means, and to tailor the advertisements shown to you on our website and other websites.
9. To analyse how our services are used, in order to improve their quality.
10. For purposes incidental to those above.
4. Changes to the purposes of use
We may change the purposes for which we use personal information, within a scope that can reasonably be regarded as related to the original purposes. If we do so, we will notify you or make an announcement on our website. Such changes take effect when published on this website.
5. Cookies and similar technologies
1. Our services may use cookies and similar technologies, including pixels, web beacons, and other online tracking technologies. These technologies help us understand how our services are used and allow us to improve them.

3. We may permit third parties and service providers to use cookies on our website in order to tailor the services, products, and advertising shown to you on our website and other websites.
4. If you wish to disable cookies, you can do so through your web browser settings. Please note that disabling cookies may prevent you from using some features of our services, and that disabling cookies may not entirely prevent information from being shared with third parties such as advertising partners.
6. Security of personal information
To ensure the accuracy and security of personal information, we take necessary and appropriate measures to manage it safely against risks such as loss, destruction, alteration, and leakage. We also provide necessary and appropriate supervision of our employees. Where we outsource all or part of the handling of personal information, we provide necessary and appropriate supervision of the contractor to ensure that personal information is managed safely.
7. Disclosure of personal information to third parties
1. Except where permitted by the Personal Information Protection Act or other laws, we do not handle personal information beyond the scope necessary to achieve the purposes of use without your consent. This does not apply in the following cases.

(2) Where necessary to protect a person's life, body, or property, and it is difficult to obtain your consent
(3) Where particularly necessary to improve public health or promote the sound development of children, and it is difficult to obtain your consent
(4) Where it is necessary to cooperate with a national government body, a local authority, or a party commissioned by them in carrying out duties prescribed by law, and obtaining your consent would risk impeding those duties
(5) Where the following matters have been announced or published in advance

● The categories of data disclosed to third parties
● The means or method of disclosure to third parties
● That disclosure of personal information to third parties will be stopped at the request of the individual
2. Notwithstanding the preceding paragraph, the following are not regarded as third parties.
● Where all or part of the personal information is outsourced within the scope necessary to achieve the purposes of use
● Where personal information is provided in connection with a business succession due to a merger or other cause
● Where personal information is used jointly with specific parties, and the individual has been notified in advance, or the information is readily accessible to the individual, regarding that fact, the categories of information used jointly, the scope of the parties involved, their purposes of use, and the name of the party responsible for managing the information

8. Disclosure to third parties located abroad

- Delivery companies (Socialist Republic of Vietnam): to deliver products to customers within Vietnam. Name, delivery address, and telephone number
2. For information on the personal information protection regimes of each country, please refer to the surveys of foreign systems published by Japan's Personal Information Protection Commission. 3. If it becomes necessary to provide personal information to a third party located abroad other than those listed above, we will provide the required information in advance and obtain your consent, in accordance with the Personal Information Protection Act.
9. Retention period
We retain your personal information only for as long as necessary to achieve the purposes of use and for any period required by law. The actual retention period depends on whether the information is needed to maintain your account, provide our services, meet legal obligations, resolve disputes, or enforce contracts and terms.
10. Proper acquisition of personal information
We acquire personal information properly and do not obtain it by deception or other improper means.
11. Disclosure of personal information
Where you request disclosure of personal information under the Personal Information Protection Act, we will confirm that the request comes from you and then make the disclosure without delay (if the personal information does not exist, we will notify you accordingly). This does not apply where we are not obliged to make the disclosure under the Personal Information Protection Act or other laws.
12. Correction or deletion of personal information
1. If personal information we hold about you is incorrect, you may request that it be corrected, added to, or deleted ("corrected") in accordance with the Personal Information Protection Act.
2. On receiving such a request, if we determine that we need to comply with it, we will carry out any necessary investigation without delay, within the scope necessary to achieve the purposes of use, and where we determine that we need to comply, we will correct the personal information and notify you accordingly (if we decide not to make the correction, we will notify you of that decision). This does not apply where we are not obliged to make the correction under the Personal Information Protection Act or other laws.
13. Suspension of use of personal information
Where you request that we suspend or erase the use of your personal information under the Personal Information Protection Act, on the grounds that it is being handled beyond the purposes of use published in advance or that it was obtained by deception or other improper means, we will carry out the necessary investigation without delay, confirm that the request comes from you, suspend or erase the use of the personal information based on the results, and notify you accordingly. Where suspension or erasure would involve substantial cost or would otherwise be difficult, we will take alternative measures. This does not apply where, following the necessary investigation, we are not obliged to suspend use under the Personal Information Protection Act or other laws.
14. Children's personal information
Our services are not intended for use by children, and we do not knowingly collect personal information about children. If you are the parent or guardian of a child who has provided us with personal information, you may request its deletion by contacting us using the details in Section 20.
15. Content you post
If you post product reviews or other content in a public area of our services, that content will be visible to third parties. We cannot control who accesses information you have made public, so please take care when posting.
16. Links to external sites
Our website may contain links to websites and platforms operated by third parties. For sites not affiliated with or controlled by us, please review that site's privacy policy and terms of use. We accept no responsibility for how personal information is handled on those sites, nor for the accuracy, completeness, or reliability of the information published there.
17. Personal information collected for the KOL Gifting & Affiliate Program
If you apply to our "EMROSE KOL Gifting & Affiliate Program" (the "Program"), we collect the following additional personal information and use it solely to operate the Program.
- Social media account information: account name, URL, follower count, and similar
- Height: to select the correct product size to send you
- Bank account details: to pay your affiliate commission (collected only from those accepted into the Program)
We use this information solely to review applications, ship the relevant products, issue and manage discount codes, calculate and pay affiliate commission, and communicate with you about the Program, and for no other purpose. Bank account details are retained only for as long as necessary to process commission payments.
